Employers must provide a contract to all employees within a week of their arrival on the farm to ensure workers are aware of their full employment terms and conditions.

It’s also recommended to send a copy of the contract to HOPS in advance so that the document can be shared with the worker prior to their arrival – helping to reassure them that the work is confirmed.

Employers should also be aware that the Government has adapted right to work checks to make it easier for businesses to carry them out during the coronavirus outbreak.

The changes mean that prospective workers are now able to submit scanned documents, rather than originals, to show they have a right to work.

Checks continue to be necessary and it is an offence to knowingly employ anyone who does not have legal immigration status in the UK.

HOPS still recommends that employers should continue to request original copies, if this can be managed safely with the resources available, to reduce chasing these up at a later date when the rules are reverted.
